Terms of Service

1. Service description

Lunar is a software-as-a-service platform that analyses customer conversation data and correlates it with external data sources such as weather, news, and economic indicators. The platform provides trend detection, sentiment analysis, and actionable insights through a web-based dashboard.

2. Account registration

To use Lunar, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

3. Acceptable use

You agree not to:

• Upload content that is illegal, defamatory, or infringes on the rights of others.
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure.
• Use the platform to process data in violation of applicable data protection laws.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Use automated tools to scrape, crawl, or otherwise extract data from the platform beyond the provided API.
• Resell or redistribute access to the platform without written consent from Intelsoft Ltd.

4. Subscription and billing

Lunar offers paid subscription plans billed in GBP. All payments are processed securely through Stripe. By subscribing, you authorise Stripe to charge your chosen payment method on a recurring basis according to your selected plan.

• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds are not provided for partial billing periods, except where required by law.
• We reserve the right to change pricing with 30 days written notice. Existing subscriptions will be honoured until the end of the current billing period.

5. Data ownership

You retain full ownership of all conversation data and other content you upload to Lunar. By uploading data, you grant Intelsoft Ltd a limited licence to process that data solely for the purpose of providing the service to you. We do not claim any intellectual property rights over your data.

You may export or delete your data at any time. Upon account deletion, all your data is permanently removed within 30 days.

6. Intellectual property

The Lunar platform, including its design, code, algorithms, and documentation, is the intellectual property of Intelsoft Ltd. Nothing in these terms grants you any rights to our intellectual property beyond the right to use the platform as a subscriber.

Insights and analytics generated by Lunar from your data are yours to use without restriction.

7. Availability and support

We aim to maintain high availability of the platform but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance where possible. We provide support via email at hello@intelsoft.co.uk.

8. Limitation of liability

To the fullest extent permitted by law, Intelsoft Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the platform.

Our total liability for any claim arising from these terms or your use of Lunar shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

9. Disclaimer

Lunar is provided on an "as is" and "as available" basis. Insights generated by the platform are intended to assist your decision-making but should not be treated as definitive advice. We do not warrant that the analytics will be error-free or that external data correlations will be accurate in all cases.

10. Termination

We may suspend or terminate your access to Lunar if you breach these terms, with or without notice depending on the severity of the breach. You may terminate your account at any time by contacting us or using the account settings.

Upon termination, your right to use the platform ceases immediately. Sections relating to data ownership, limitation of liability, and governing law survive termination.

11. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or through a notice on the platform at least 30 days before they take effect. Continued use of Lunar after changes take effect constitutes acceptance of the updated terms.
